These Terms & Conditions ("Terms") govern your use of the Sydney Self-Driving Audio Tour ("Service") provided by Australian Private Tours ("we", "us", "our") through the website sydneytourguide.com.au. By purchasing access or using the Service you agree to these Terms in full. If you do not agree, do not use the Service.

1. Safety & Driving

The Service is designed for use by vehicle passengers. If you are the driver:

• Your full attention must remain on the road, traffic and surroundings at all times.
• Do not interact with, look at or adjust the device while driving.
• Comply with all applicable road rules and distracted-driving laws.
• Set up the tour and connect to your car speakers before you start driving.

We are not responsible for any accident, injury, death, property damage or any other loss arising from the use of this Service while operating a vehicle or otherwise.

2. Content Accuracy

The audio commentary is provided for entertainment and educational purposes only. While we strive for accuracy, the information may contain inaccuracies, be outdated or differ from current conditions. We do not warrant the completeness or correctness of any content and accept no liability for errors or omissions.

3. GPS & Technology

The Service depends on your device's GPS, internet connection and browser capabilities. Audio playback may not trigger correctly in areas with poor GPS signal, limited data coverage or incompatible devices. We do not guarantee uninterrupted, error-free or secure operation of the Service.

4. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any direct, indirect, incidental, special, consequential or punitive damages including but not limited to personal injury, property damage, lost profits, loss of data or business interruption arising from or related to your use of (or inability to use) the Service, even if we have been advised of the possibility of such damages.

Our total liability for any claim related to the Service is limited to the amount you paid for your access.

5. Assumption of Risk

You expressly assume all risk associated with the use of this Service, including risks related to driving, navigation, visiting tour locations and reliance on the audio content. You are solely responsible for your own safety and the safety of others around you.

6. Indemnification

You agree to indemnify and hold harmless Australian Private Tours, its owners, employees and agents from any claims, damages, losses or expenses (including legal fees) arising from your use of the Service or violation of these Terms.

7. "As Is" Disclaimer

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose or non-infringement.

8. Access & Refunds

Access links are time-limited and locked to one device. We do not provide refunds for purchased access. If you experience a technical issue, contact us and we will do our best to resolve it.

9. Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

10. Governing Law

These Terms are governed by the laws of New South Wales, Australia.
